Terms of Service

1. Agreement to these Terms
These Terms of Service (“Terms”) govern your access to and use of ICAP — International Cognitive Aptitude Profiling (“ICAP,” “we,” “us,” or “our”) and the services we provide (the “Service”). By creating an account, making a payment, or taking an assessment, you agree to be bound by these Terms, together with our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.
2. The Service
ICAP is a paid, single-attempt, timed cognitive assessment platform. You register an account, pay a one-time fee per assessment, complete a timed test in a locked single session, and receive a cognitive performance report; a performance tier and a shareable digital badge are added once calibration completes. Each paid assessment entitles you to exactly one attempt.
3. Eligibility
The Service is available only to individuals who are 18 years of age or older. By using the Service, you represent and warrant that you are at least 18. We do not knowingly provide the Service to, or collect information from, anyone under 18.
4. Accounts
- One account per person. You may hold only one account and may not share it with, or take an assessment on behalf of, anyone else.
- Accurate information. You agree to provide true, current, and complete information (including profile details used to personalize your report) and to keep it up to date.
- Security. You are responsible for activity under your account and for keeping your access to it secure.
- Termination. We reserve the right to suspend or terminate your account for any violation of these Terms, including the test-integrity and anti-reproduction clauses below.
5. Payments and Credits
- Assessments are priced at ₹99 per test type (subject to change for future purchases; the price shown at checkout applies to your purchase).
- Each successful payment grants one test credit for the selected test type. Payments are processed by our third-party payment provider, and a credit is granted only after that provider confirms the payment to us.
- A credit is consumed at the moment you start a test attempt. Once consumed, it entitles you to that single attempt only.
- Refunds are governed by our Refund Policy.
6. Test Integrity
Each assessment must be completed personally, by the registered account holder alone, in a single sitting, without assistance from any other person, tool, software, or external resource. The Service measures your own, unaided performance.
We may employ technical and manual measures to protect the integrity of assessments. If we determine, in our reasonable judgment, that an attempt was completed in violation of this clause, we may void the result and/or terminate your account, without refund.
7. Intellectual Property
All Rights Reserved. All test items, item banks, questions, scoring methodology, norms, report formats, badge designs, archetype and tier labels, branding, trademarks, text, graphics, and platform software are the exclusive property of ICAP or its licensors and are protected by applicable intellectual-property laws.
No license or right is granted to you except a limited, personal, non-commercial right to view and share your own individual report and badge. All other rights are reserved.
8. Anti-Reproduction of Test Content
You may not reproduce, photograph, screenshot, record, transcribe, copy, distribute, publish, or share any test item, question, or assessment content, in any form and for any purpose, whether during or after an assessment. Violation of this clause may result in immediate account termination and legal action.
9. Research Grounding
ICAP's assessments are built on open-source, peer-reviewed cognitive ability research. The Service provides a cognitive performance baseline and psychometric benchmark; it is a descriptive profiling tool, not a substitute for professional evaluation.
10. Non-Clinical Nature & Disclaimer
ICAP is expressly positioned as a non-clinical, non-diagnostic self-assessment tool. It does not diagnose, treat, or evaluate any medical, psychological, or psychiatric condition, and must not be relied upon for any such purpose.
ICAP™ (International Cognitive Aptitude Profiling) is an independent psychometric benchmarking organization. It provides a personal cognitive performance profile based on open-source cognitive-ability assessment frameworks and is not intended to serve as a clinical, medical, or diagnostic psychological evaluation.
11. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or available at any particular time, or that results will be fit for any particular purpose.
12. Limitation of Liability
To the maximum extent permitted by law, ICAP's total aggregate liability to you for any and all claims arising out of or relating to the Service is limited to the amount you actually paid for the assessment giving rise to the claim (i.e. ₹99). We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
13. Indemnification
You agree to indemnify and hold harmless ICAP and its officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your misuse of the Service or your violation of these Terms.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of India. The courts at Thane, Maharashtra, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
15. Dispute Resolution
Before initiating any formal proceeding, you agree to first attempt to resolve the dispute informally by contacting us at hello@icap-test.com, and to allow a reasonable period for a good-faith resolution.
16. Severability
If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and ICAP regarding the Service and supersede any prior agreements.
18. Changes to these Terms
We may update these Terms from time to time. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. We will take reasonable steps to flag material changes.
19. Force Majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, outages, network or payment-provider failures, or governmental actions.
